1. Scope and acceptance
These Terms apply when you use TalkThem, create an account, connect a website, install the visitor widget or purchase a subscription. TalkThem is primarily intended for businesses, support teams and other professional users. If you use the service for an organization, you represent that you are authorized to bind that organization to these Terms.
2. Accounts and security
You are responsible for accurate account information and for protecting passwords, two-factor authentication methods and signed-in devices. You must not share credentials with unauthorized people, bypass role restrictions or access another workspace without permission. If compromise is suspected, change credentials and revoke unnecessary sessions promptly.
3. Workspaces, websites and content
The workspace owner is responsible for connected websites, operators, message content, templates, automated replies and other data submitted by the organization. You retain rights in your content and grant TalkThem only the limited rights needed to host, process, transmit, protect, support and improve the service.
4. Acceptable use
Customer must comply with the Acceptable Use Policy (AUP), which forms part of these Terms. TalkThem may not be used in connection with unlawful, fraudulent, deceptive, harmful or exploitative activity, including phishing, malware, credential theft, scams, unlawful trade, exploitation of persons, attacks on infrastructure, sanctions evasion or other conduct prohibited by applicable law. Customer is also responsible for the activities of Sites on which the TalkThem widget is installed.
5. Responsibilities toward website visitors
If you place the TalkThem widget on your website, you are responsible for identifying the lawful basis for visitor communications and data collection, providing required notices and obtaining consent where applicable. TalkThem does not replace your own privacy notice and does not independently determine the purposes for which your organization communicates with its visitors.
6. Plans, trials and limits
Available plans, prices and limits for websites, members, conversations and analytics retention are shown in the product and may change for future billing periods. Trial access is temporary and intended for evaluation. When plan limits are reached, TalkThem may restrict creation of new resources while preserving existing information according to applicable retention settings.
7. Payments and cryptocurrency checkout
Cryptocurrency payments are processed through NOWPayments or another provider clearly identified at checkout. A payment is complete only after the provider confirms it and TalkThem verifies the payment server-side. Network fees, conversion rates and provider fees may affect the amount that must be sent. Do not submit a second payment when the interface indicates that an existing transaction is already being processed.
8. Renewal, downgrade and cancellation
A paid subscription remains available through the paid-through date. Where renewal requires a new payment, TalkThem may create a renewal invoice and provide a limited grace period. Cancellation at period end does not remove access before the paid period expires. A scheduled downgrade normally takes effect at the next renewal unless the product interface states otherwise.
9. Refunds
Refunds are not automatic and may be reviewed based on payment circumstances, service already provided and applicable law. If a Site, Workspace or Account is suspended or terminated because of a material breach of these Terms or the AUP, prepaid fees are generally non-refundable, except where a refund is required by applicable law or expressly approved by TalkThem. Suspension or termination does not relieve Customer of amounts already due and payable.
10. Availability and service changes
We work to keep TalkThem reliable but do not promise uninterrupted availability. Maintenance, upgrades, third-party provider limitations, network incidents and product changes may affect the service. Where practical, material changes that substantially affect use of the service will be communicated in a reasonable manner.
11. Third-party services
TalkThem may interact with services such as Cloudflare, NOWPayments, Firebase, Telegram, email delivery providers and other external systems. Their own terms and privacy policies apply to activities they perform independently.
12. Intellectual property
The TalkThem software, design, branding, documentation and interfaces are owned by or lawfully licensed to the service operator. These Terms do not transfer ownership of TalkThem to you. You receive only the right to use the service within the scope of your account and subscription.
13. Suspension and termination
TalkThem may quarantine a specific Site or widget, suspend a Workspace, or terminate an Account for a material breach of the Terms/AUP, security threats, fraud, non-payment or legal requirements. For phishing, malware, active fraud, exploitation of persons, security attacks or another urgent threat, action may be taken immediately without prior notice. Where the risk is not urgent and it is reasonable and safe to do so, TalkThem may provide an opportunity to remedy the issue.
14. Disclaimers and limitation of liability
The service is provided as available. To the extent permitted by law, TalkThem does not warrant that every error will be eliminated or that the service will interoperate with every third-party system, and is not liable for indirect, incidental or consequential losses, loss of profit or loss caused by events outside reasonable control. Mandatory consumer or statutory rights that cannot be excluded remain unaffected.
15. Changes to these Terms
These Terms may be updated as the product, legal requirements and billing model evolve. The current version will be published on this page with an updated date. For material changes, TalkThem may require renewed affirmative acceptance through the product. Continued use after changes take effect may also constitute acceptance to the extent allowed by applicable law.
16. DPA, privacy configuration and regional requirements
Where TalkThem processes personal data on Customer’s behalf, the Data Processing Addendum forms part of these Terms. Customer is responsible for configuring the widget, Privacy Mode and its CMP/consent mechanism as required by applicable law and Customer’s own privacy notices. The current subprocessor list is published separately. Special regulated-industry requirements apply only when expressly agreed in writing.
17. Contact
Questions about these Terms can be submitted through the official TalkThem support channel available through talkthem.com or the authenticated panel at panel.talkthem.com.
