1. Scope
This Acceptable Use Policy (“AUP”) forms part of the TalkThem Terms of Use and applies to Accounts, Workspaces, connected Sites, widgets, APIs, operator applications, integrations, automation and any content or traffic processed through the service.
2. Lawful use
TalkThem may not be used in connection with unlawful, fraudulent, deceptive, harmful, exploitative or otherwise prohibited activities. You must comply with applicable law, third-party rights, privacy, electronic-commerce, marketing, sanctions and export-control requirements.
3. Prohibited activities
You may not use TalkThem, or deploy it on a website or service primarily engaged in or facilitating, fraud or scams; phishing, credential theft or impersonation; malware, botnets, exploitation of vulnerabilities or attacks; trafficking in stolen data or goods; sexual exploitation, CSAM or human trafficking; unlawful drugs, weapons or other prohibited goods; unlawful surveillance; bulk spam; systematic intellectual-property infringement; sanctions evasion; money laundering; or other conduct prohibited by applicable law.
4. Harm to the service or third parties
You may not use TalkThem for DDoS, probing concealed administrative interfaces, circumventing technical restrictions, abusive automated load, interference with security controls, distribution of malicious files, threats, harassment, deception of visitors, or other conduct that creates material risk to users, third parties, TalkThem, its infrastructure or providers.
5. Responsibility for connected Sites
The Account owner is responsible for Sites connected to TalkThem, including where a Site is operated by an employee, contractor or other person granted access. Installation of the TalkThem widget does not constitute endorsement by TalkThem of the Site or its activities.
6. Investigation and cooperation
Where there are reasonable indications of abuse, TalkThem may request information, temporarily restrict a feature or Site, preserve necessary security records, and cooperate with payment, infrastructure, law-enforcement or other competent entities to the extent required by law or reasonably necessary to protect the service.
7. Site quarantine, suspension and termination
TalkThem may quarantine a specific Site or widget, suspend a Workspace, or terminate an Account where there are reasonable grounds to believe that this AUP or the Terms have been materially breached. For phishing, malware, active fraud, exploitation of persons, security attacks, immediate threats to users or infrastructure, or where required by law, action may be taken immediately without prior notice.
8. Notice and opportunity to cure
Where the risk is not urgent and it is reasonable and safe to do so, TalkThem may notify the Account owner and provide an opportunity to remedy the issue. Notice is not a condition precedent to urgent protective action.
9. Fees and refunds following breach
If a Site, Workspace or Account is suspended or terminated due to a material breach of the Terms or this AUP, prepaid fees are generally non-refundable, except where a refund is required by applicable law or expressly approved by TalkThem. Suspension or termination does not relieve the Customer of amounts already due and payable.
10. Changes and contact
TalkThem may update this AUP as threats, the product and legal requirements evolve. Material changes will be published on this page. Questions about acceptable use can be submitted through the official TalkThem support channel.
